ON BACKGROUND
Today, the Supreme Court declined to accept an appeal from the NFL that requested the case be handled through its arbitration process rather than open court in New York. The Second Circuit Court of Appeals’ August ruling that NFL Commissioner Roger Goodell lacks the neutrality necessary to preside over such proceedings will stand.
ON RECORD
Statement from Douglas Wigdor (Founding Partner, Wigdor LLP) and David Gottlieb (Partner, Wigdor LLP):
“We are pleased that the Supreme Court declined to accept the NFL’s appeal. The NFL must now accept that its commissioner cannot be the arbitrator over discrimination claims against the league and its teams. We look forward to litigating these claims in court.”
