Summary Judgement Denied in Palmer v. eCapital Corp

A New York federal court ruled that Wigdor presented sufficient evidence from which a jury could find that former eCapital Corp. CEO Jennifer Palmer was the victim of sex discrimination and retaliation.  The court based its decision on evidence Wigdor adduced showing that eCapital employed only men in high-level senior executive positions, that Ms. Palmer was the only female in such a role, and that eCapital replaced Palmer with a man.  The court likewise cited evidence that eCapital treated the company’s male executives, including Ms. Palmer’s male predecessor, better than her, and that Ms. Palmer was fired despite evidence of “her business unit’s increasing profits under her leadership.” Finally, the Court found that a jury could award Ms. Palmer punitive damages for eCapital’s unlawful conduct.  The case is expected to go to trial in October.
